1. About this policy

This Privacy Policy explains how QSR Brokers (ABN 82 181 672 523) ("QSR Brokers", "we", "us", "our") collects, holds, uses and discloses personal information, and how you can access or correct your information or make a complaint. QSR Brokers is a Queensland-based specialist broker of Quick Service Restaurant (QSR) businesses, operating under real estate/business agent licence number 4963386.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and we apply this policy across our business regardless of any small business turnover exemption that might otherwise be available to us.

2. What personal information we collect

The information we collect depends on how you interact with us:

• General website visitors: contact details you provide via an enquiry form (name, email, phone, message content) and technical/usage data (see Section 9, Cookies).
• Sellers: name, business name and address, contact details, and business/financial information relevant to appraising and marketing your business for sale (profit and loss information, lease and franchise details, equipment lists, staffing information, and reason for sale).
• Buyers: name, contact details, budget range, preferred location(s) and business categories, industry/operating experience, finance readiness, and engagement with our buyer education program (guides accessed, webinars attended, education stage reached).
• Third parties named in listing materials: where a seller provides information about staff, landlords, or suppliers as part of a listing (for example in a lease), we may incidentally hold limited personal information about those individuals, which we treat as confidential and use only for the purpose of progressing the relevant transaction.

We do not intentionally collect sensitive information (such as health information) and ask that you not include sensitive information in free-text fields unless it is genuinely necessary and relevant.

3. How we collect personal information

• Directly from you, via our website forms, email, phone, or in-person meetings.
• From our buyer education platform, when you register for or engage with guides, webinars, or checklists.
• From our customer relationship management (CRM) and marketing automation tools, which record your enquiries, communications, and engagement history.
• From publicly available sources or industry contacts, in limited cases (for example, identifying that a franchise term is approaching expiry) — we do not use this to build profiles of individuals beyond what is reasonably necessary for our brokerage function.

4. Why we collect, hold, use and disclose personal information

We use personal information to:

• Appraise, market, and sell a seller's business, and manage enquiries about a listing;
• Qualify buyers (financial capacity, seriousness, and category fit) before releasing confidential listing information, gated behind a signed non-disclosure agreement (NDA);
• Match buyers to new listings and send priority notifications (see Section 5, Automated decision-making, below);
• Deliver our buyer education program (guides, webinars, checklists) and track engagement so we can tailor content to your stage of readiness;
• Communicate with you about your enquiry, listing, or transaction, including status updates;
• Coordinate due diligence, document exchange, and settlement between sellers, buyers, financiers, and solicitors, with your authorisation;
• Comply with our licensing, record-keeping, and other legal obligations as a licensed real estate/business agent; and
• Improve our services, including analysing which content and channels are effective (in de-identified or aggregated form where practical).

5. Automated decision-making — how we use scoring and matching tools

Plain-English summary: We use software tools (including AI-assisted tools) to help our licensed broker triage seller enquiries and shortlist buyers for new listings. A person always makes the final call on anything that matters — these tools help us work faster, they do not replace our judgement.

We use software-assisted processes, including artificial intelligence tools, to support two functions:

• Seller enquiry scoring. When you submit a seller enquiry, we use a scoring process to indicate priority (for example, based on urgency and information completeness) so that our licensed broker can respond quickly to time-sensitive enquiries. This score informs, but does not replace, our broker's review of every enquiry.
• Buyer matching and shortlisting. When a new listing becomes available, we use a matching process to rank registered buyers against listing criteria (budget, location, experience, finance readiness, and education stage completed) and to prioritise who is notified first. This can affect how quickly you learn about a listing that matches your profile.

These processes do not make a final decision about whether you can buy or sell a business, what price is offered, or whether an offer is accepted — those decisions are always made, or approved, by our licensed broker. No confidential listing information is released to a buyer as a result of these processes alone; that always requires a signed NDA and a broker-approved release. You may ask us for more information about how a particular score or match was generated by contacting us using the details in Section 12.

6. Direct marketing and buyer education communications

If you register as a buyer or otherwise opt in, we will send you educational content, webinar invitations, and listing notifications by email or SMS in accordance with the Spam Act 2003 (Cth). Every marketing message includes a functional unsubscribe mechanism, and we will stop sending marketing communications promptly once you unsubscribe or withdraw consent. Transactional or service messages relating to an active listing, enquiry, or transaction you are involved in are not marketing and may continue even if you unsubscribe from general marketing.

7. Disclosure of personal information to third parties

We may disclose personal information to:

• Our licensed broker and any authorised staff or contractors;
• Prospective buyers or sellers, but only confidential business/financial information after a signed NDA and broker approval, and never a seller's identity or premises location before that point;
• Service providers who help us run our business, including our customer relationship management (CRM) platform, workflow automation tools, e-signature platform, secure digital data room, and AI-assisted drafting and matching tools — these providers are only authorised to use personal information to provide services to us;
• Advertising platforms (Google Ads, Meta/Facebook Ads) for the limited purpose described in Section 9 (Cookies and online advertising);
• Franchisors, landlords, financiers, accountants, and solicitors involved in a specific transaction, with your authorisation;
• Regulators, professional bodies, or as required or authorised by law, including in connection with our real estate/business agent licence; and
• A party acquiring all or part of our business, subject to confidentiality protections.

We do not sell personal information to third parties.

8. Overseas disclosure

Some of the service providers referred to in Section 7 (for example, our CRM, workflow automation, e-signature, and AI-assisted tooling providers) may store or process personal information on servers located outside Australia, including in the United States. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles the information consistently with the Australian Privacy Principles, including through the provider's own privacy and security commitments, and we do not disclose confidential seller financial information to any overseas recipient beyond what is reasonably necessary to operate the relevant tool. 9. Cookies and online advertising

Our website uses cookies and similar technologies, including advertising pixels from Google Ads and Meta (Facebook/Instagram) Ads, to understand how the site is used and to show relevant advertising to people who have visited our site (retargeting). You can control or disable cookies through your browser settings; disabling cookies may affect some website functionality. We do not use cookies to collect sensitive information.

10. Data quality and security

We take reasonable steps to keep personal information accurate, complete, and up to date, and to protect it from misuse, interference, loss, unauthorised access, modification, or disclosure, including access controls on our CRM and digital data room, NDA-gating of confidential listing information, and use of reputable, security-conscious service providers. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.

We retain personal information only for as long as reasonably necessary for the purposes described in this policy or as required by law or our licensing obligations, after which we take reasonable steps to destroy or de-identify it.

11. Access, correction, and complaints

You may request access to, or correction of, the personal information we hold about you by contacting us using the details in Section 12. We will respond within a reasonable period and, in most cases, at no cost. If you wish to make a complaint about how we have handled your personal information, please contact us first so we can try to resolve it directly. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
